These general terms and conditions of sale are agreed between, on the one hand, SAS Decathlon Cycling Team – 604 rue Denis Papin – 73290 La Motte-Servolex – France – and, on the other hand, internet users who wish to purchase an item presented on the "DECATHLON CMA CGM TEAM" website, available at: https://decathloncmacgmteam.com hereinafter referred to as "the Customer."
These terms and conditions govern the sale of any product presented on the website "https://decathloncmacgmteam.com" by Decathlon Cycling Team. The parties agree that their relationship will be governed exclusively by this contract, to the exclusion of any other terms and conditions. Items are offered for sale only to individuals who are not commercial entities.
1. ACCEPTANCE OF THE CONDITIONS
You declare that you have read and accepted the present general conditions of sale before placing your order.
2. PRICE
The prices of our products are indicated in euros all taxes included except participation in the expenses of treatment and forwarding.
The prices indicated take into account the VAT applicable to this day. If one or several rates were to be modified, in rise or in fall, during the season, this change will be reflected on the price of the articles.
The products remain the property of Decathlon Cycling Team until full payment has been received by Decathlon Cycling Team.
3. ORDER
To place an order, the Customer fills their shopping cart and pays by credit card. Decathlon Cycling Team reserves the right to cancel any order from a customer with whom there is a dispute regarding payment for a previous order.
The information given by the buyer when placing the order is binding on the buyer: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.
4. AVAILABILITY
Decathlon Cycling Team does not intend to sell the products offered in large quantities. Consequently, Decathlon Cycling Team reserves the right to refuse orders for the same product in large quantities, starting from 5 identical items.
Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks. For products not stocked in our premises, our offers are valid subject to availability from our suppliers.
In this context, information on the availability of products is provided to you at the time of placing your order. This information coming directly from our suppliers, errors or modifications can exceptionally exist. In the event of unavailability of product after placing your order, we will inform you by mail or by post upon receipt of information received by the suppliers. Your order will be automatically cancelled and you will be immediately refunded.
In case of unavailability of all or part of the order, the refund will be made by check, at the latest within thirty days from the payment of the sums paid by the Customer.
5. DELIVERY
Delivery will be made within 10 days of receipt of payment for the order and within 30 days for French overseas departments and territories and foreign countries, excluding any unforeseeable circumstances or force majeure that would delay delivery beyond the control and diligence of Decathlon Cycling Team.
Delivery will be made by La Poste. Possible delays do not give the buyer the right to claim damages.
For reasons of availability, an order can be delivered in several times to the customer. In this case, the customer only pays for one delivery. If the customer wishes 2 places of delivery, he places 2 orders, with the related delivery charges.
6. PAYMENT
The price of the products is payable by check or credit card. The Customer also has the possibility of making his payment by Money Order.
The reception of the order form accompanied by the payment will be worth irrevocable engagement between the parts.
Furthermore, Decathlon Cycling Team reserves the right to refuse any order from a customer with whom there is a dispute. Decathlon Cycling Team will process the order upon receipt of payment from the customer.
7. WITHDRAWAL AND REFUND
The period during which the customer may request an exchange or exercise his right of withdrawal is 14 days from the date of receipt of the item(s). When the 14-day period expires on a Saturday, Sunday or holiday, it is extended to the next working day.
The return of the item(s) within this period must be accompanied by a copy of the purchase invoice. In addition, the item(s) must be returned in their original packaging and complete (packaging, accessories, labels, etc.) to the following address: Decathlon Cycling Team – Club des Supporters – 604 rue Denis Papin – 73290 La Motte-Servolex – France.
Items returned incomplete, damaged or soiled by the customer will not be accepted.
If the right of withdrawal is exercised, Decathlon Cycling Team is required to exchange or refund the sums paid by the customer, free of charge, with the exception of return shipping costs. The refund is due within a maximum of 14 days following the date on which the right of withdrawal was exercised.
Refunds will be made using the same payment method used by the customer, unless otherwise agreed between the customer and Decathlon Cycling Team.
To exercise the right of withdrawal, the customer must notify Decathlon Cycling Team of their decision to withdraw from this contract by means of an unambiguous statement (e.g., letter sent by post or email). The customer may use the following model withdrawal form, but this is not mandatory.

8. GUARANTEE
The seller is liable for defects in the conformity of the goods to the contract under the conditions of Article L. 211-4 et seq. of the Consumer Code and for hidden defects in the thing sold under the conditions provided for in Articles 1641 et seq. of the Civil Code. (Article 2 of the order of December 18, 2014)
Decathlon Cycling Team reminds consumers that under the legal guarantee of conformity:
- he has a period of 2 years from the delivery of the property to act;
- he can choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;
- he is exempted from proving the existence of the lack of conformity of the goods during the 6 months following the delivery of the goods. This period is extended to twenty-four months as of March 18, 2016, except for used goods;
- the legal guarantee of conformity applies independently of any commercial guarantee that may have been granted;
- the consumer can decide to implement the guarantee against the hidden defects of the sold thing within the meaning of the article 1641 of the civil code and that, in this hypothesis, he can choose between the resolution of the sale or a reduction of the selling price according to the article 1644 of the civil code.
9. DISPUTES
This contract is subject to French law.
Decathlon Cycling Team cannot be held liable for any damage of any kind, whether material, immaterial, or physical, that may result from the malfunction or misuse of the products sold. The same applies to any modifications to the products made by the manufacturers. Decathlon Cycling Team's liability shall, in any event, be limited to the amount of the order and shall not be invoked for simple errors or omissions that may have remained despite all the precautions taken in the presentation of the products.
In case of difficulties in the application of the present contract, the purchaser has the possibility, before any legal action, to seek an amicable solution in particular with the assistance of: a professional association of the branch, an association of consumers or any other council of his choice.
It is reminded that as a general rule and subject to the appreciation of the Courts, the respect of the provisions of the present contract relating to the contractual guarantee supposes that the purchaser honors his financial commitments towards the seller.

10. INTELLECTUAL PROPERTY AND COMPETITION
All elements of the DECATHLON CMA CGM TEAM website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks, or patents.
Users who have a personal website and wish to place a simple link on their site for personal use that directs to the DECATHLON CMA CGM TEAM website homepage must first obtain authorization from Decathlon Cycling Team. This does not constitute an implicit affiliation agreement.
